Public Offer and Website Terms of Use

CHARITABLE FOUNDATION “GROW UP IN A FAMILY” (EDRPOU code 44300932, registered address: Apt. 1, 9A Prytsustvenna St., Radomyshl, Radomyshl District, Zhytomyr Region, 12201; account UA513226690000026005300208759 at JSC “Oschadbank”; hereinafter — the “Foundation” or “We”) invites any legally competent person (hereinafter — the “User” or “You”) to accept this Public Offer and the Terms of Use of the infamily.org.ua website (hereinafter — the “Site”) under the terms set out below.

1. Definitions

1.1. "Site" means the collection of web pages under the domain infamily.org.ua and all subdomains.

1.2. "Donation" means a non-refundable, voluntary transfer of funds by the User to the Foundation for its statutory purposes.

1.3. "Acceptance" means the full and unconditional acceptance of the terms of this Offer by clicking a button or link to make a donation, navigating to an external payment page, paying an invoice, making a bank transfer, or the actual transfer of funds.

1.4. "Personal Data" means any information that directly or indirectly relates to an individual and is provided by the User through forms on the Site.

2. Subject of the Offer

2.1. The Foundation undertakes to accept the Donation from the User and use it in accordance with its statutory purposes.

3. Procedure for Acceptance and Payment

3.1. The Foundation’s website does not contain its own payment form and does not process payment card data directly. To make a charitable donation, the User may follow an external link to a bank or payment service page, including LiqPay or Monobank, select a fundraising page for a specific project, or use the bank details provided on the Site.

3.2. After clicking a button or link to make a donation, the User may be redirected to an external resource operated by the relevant bank or payment service. Payment processing, transaction confirmation, and the technical processing of payment data are handled by the relevant bank or payment service.

4. Refunds

4.1. General rule. Charitable donations are voluntary and non-refundable.

4.2. Exceptions. The Foundation may refund funds only in the event of:

  • a duplicate or erroneous payment;
  • a technical failure of the payment system;
  • a confirmed fraudulent transaction.

4.3. Request procedure. The User must submit a written request within 14 calendar days of making the payment to the Foundation’s contact email address infamilyorg@gmail.com.

4.4. Refund method. If the donation was made through an external bank or payment service, the timing and technical feasibility of the refund may depend on that bank’s or service’s rules. Refunds are processed after the Foundation approves the request, in accordance with the laws of Ukraine and subject to the technical capabilities of the relevant payment channel.

5. Payment Security

5.1. The Foundation does not receive or store Users’ full payment card details. If a donation is made through LiqPay, Monobank or another external bank or payment service, the payment data is entered and processed by the relevant service.

5.2. The Site uses SSL encryption for data transmission between the User's browser and the Site.

6. Rights and Obligations of the Parties

6.1. The User has the right to:

  • receive information regarding the use of donations;
  • request a refund for payments made in error.

6.2. The Foundation has the right to:

  • amend this Offer by publishing the new version on the Site;
  • use Donations in accordance with its Charter.

7. Website Terms of Use

7.1. Site content is protected by copyright; any copying without the written consent of the Foundation is prohibited.

7.2. It is prohibited to publish materials on the Site that violate the law.

8. Personal Data Protection

8.1. Personal data is processed in accordance with the Privacy Policy.

9. Liability

9.1. The Site is provided "as is." The Foundation is not liable for interruptions in access, loss of User data, or the actions of third parties.

9.2. The Foundation:

  • provides no guarantees or promises regarding uninterrupted operation of the Site, absence of errors, the accuracy of all content, or its suitability for any specific user expectations;
  • is not liable for potential data loss, temporary service unavailability, the actions of third-party services (payment providers, analytics, etc.), or any damages that may arise from the use of Site materials;
  • acknowledges that the Site may contain inaccuracies or be unavailable at times, but provides access "as is" without additional obligations.

10. Accessibility Statement

The Foundation aims to comply with WCAG 2.1 Level AA. If you encounter an accessibility barrier, please contact us at infamilyorg@gmail.com.

11. Dispute Resolution

11.1. The parties shall endeavor to resolve any disputes through negotiations; if an agreement is not reached, disputes shall be settled in the courts of Ukraine at the location of the Foundation.

12. Final Provisions

12.1. This Offer enters into force upon publication on the Site and remains in effect until withdrawn.
